Make the request specific.

  1. Identify the office that created or holds the record. A city, county, state agency and court may each hold different pieces.
  2. Describe existing documents: record type, subject, case or file number, date range, and relevant department. Request records rather than asking the agency to prove a theory.
  3. Ask for an electronic copy if available, and an estimate before incurring fees. Answer commercial-purpose questions accurately.
  4. Keep the request, receipt number, responses and original files. Record when and where each item was obtained.
  5. If records are withheld or redacted, ask for the stated basis and any releasable portions. Verify next steps with the agency or qualified counsel.

To the records custodian:

I request access to or copies of the following existing records: [describe records, date range, department, subject and identifiers].

Please provide electronic copies if available. Please let me know the estimated fees before processing copies that incur a charge. If any portion is withheld or redacted, please identify the basis and provide any releasable portions. If another office holds these records, please direct me to the appropriate custodian.
